1. Acceptance of Terms
By accessing or using My Forever Books (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, you may not use our Service.
2. Description of Service
My Forever Books provides a platform for users to create personalized books from their text messages. We offer services including, but not limited to, message importing, book customization, book credit purchases, and book printing.
3. User Accounts
When you create an account with us, you must provide accurate, complete, and current information. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.
4. User Content and Rights
You retain all rights to the content you submit to the Service. By using our Service, you grant My Forever Books a limited license to use, process, and store your content solely for the purpose of creating your book. We do not claim ownership of your content and will not use it for any other purposes without your explicit consent.
5. Prohibited Uses
You agree not to use the Service to create books containing:
- Content that infringes on the rights of others
- Explicit or pornographic material
- Any other content that violates applicable laws or regulations
6. Acceptable Use Policy
When using our Service, you agree to:
- Use the Service only for lawful purposes and in accordance with these Terms
- Not attempt to gain unauthorized access to any part of the Service or its related systems
- Not engage in any activity that interferes with or disrupts the Service
- Not use the Service to send unsolicited communications (spam)
- Not impersonate any person or entity, or falsely state or misrepresent your affiliation with a person or entity
- Not use the Service in any way that could damage, disable, overburden, or impair our servers or networks
- Not use any robot, spider, or other automatic device, process, or means to access the Service for any purpose
- Comply with all applicable laws and regulations while using the Service
Violation of this Acceptable Use Policy may result in the termination of your account and access to the Service. We reserve the right to investigate and take appropriate legal action against anyone who violates these provisions, including without limitation, removing the offending content from the Service and reporting any unlawful activity to law enforcement authorities.
7. Privacy Policy
Your use of My Forever Books is also governed by our Privacy Policy. Please review our Privacy Policy, which also governs the Site and informs users of our data collection practices.
8. Data Retention and Security
We securely store your uploaded content, your text messages, to provide our Service. Your messages are encrypted in our database to protect sensitive information. We are unable to see your messages in our database. You can delete your uploaded content at any point within your dashboard.
9. Customization and Proofing
While we strive to accurately represent your customized book, it is your responsibility to carefully review and approve all proofs before finalizing your order. We are not responsible for errors in content, design, or layout that were present in the final proof you submitted.
10. Payment Terms
By purchasing through our Service, you agree to pay all fees and charges associated with your account, including book credit purchases and printed book orders. Book credit purchases, including book credits purchased for someone else, may be refundable only as described in our Refund Policy. Printed book orders are custom products and are not refundable once they have been printed and shipped.
11. Shipping and Delivery
We work with a third-party printing company that handles production and shipment of printed orders. We do our best to provide shipping and delivery estimates based on the information provided by that print partner.
Once an order enters production, delays can occur. Production times, carrier delays, customs processing, weather events, and other issues outside our control may affect delivery timing. Because of this, shipping and delivery dates are estimates only and are not guaranteed.
12. Order Cancellation
You may contact us to request cancellation or refund assistance before you submit your final proof. After you submit your final proof and the printed order enters production, cancellations may not be possible or may incur additional fees. Unused book credits are governed by the time limits and conditions in our Refund Policy.
13. Refunds and Returns
Our Refund Policy outlines the conditions under which we offer refunds, exchanges, or other assistance. In summary, unused book credits may be refunded within 30 days of purchase. For book credits purchased for someone else, refunds may only be requested by the original purchaser and may only be returned to the original payment method. Printed and shipped books are not refundable. If a printed book arrives clearly damaged or defective due to a manufacturing error or shipping damage, the customer must provide proof so we can verify the issue. Once verified, we will provide a replacement at no additional charge.
14. Limitation of Liability
In no event shall My Forever Books, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.
15. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
